1. Scope
1.1 These General Terms and Conditions (GTC) apply to all orders placed via the online shop www.amanel-lamp.com. Any deviating conditions of the customer will not be recognized unless we expressly agree to their validity in writing.
1.2 The GTC apply to consumers and entrepreneurs unless a differentiation is made in the respective clause. The customer is a consumer if the purpose of the ordered deliveries and services cannot be predominantly attributed to their commercial or independent professional activity. In contrast, an entrepreneur is any natural or legal person or a legally capable partnership that acts in the exercise of their commercial or independent professional activity when concluding the contract.

2.2 The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.
2.3 The contract is concluded through the online shopping cart system, in which you collect the goods (lampshades, lamp bases) in the so-called shopping cart, place a binding order, and subsequently receive an order confirmation from us via email.
3. Right of Withdrawal

4. Prices, Payment, and Delivery
4.1 The prices in our online shop are final prices.

5. Retention of Title
The goods remain our property until full payment has been made.
6. Warranty and Liability
6.1 The statutory liability for defects applies.
6.2 We are always liable without limitation for claims due to damages caused by us, our legal representatives, or vicarious agents:
- in the event of injury to life, body, or health,
- in case of intentional or grossly negligent breach of duty,
- in case of guarantee promises, if agreed,
- to the extent that the scope of application of the Product Liability Act is opened.
6.3 In the event of a breach of essential contractual obligations, whose fulfillment enables the proper execution of the contract in the first place and on whose compliance the contractual partner may regularly rely (cardinal obligations), due to slight negligence by us, our legal representatives, or vicarious agents, the liability is limited in amount to the foreseeable damage at the time of contract conclusion, the occurrence of which typically must be expected.
7. Dispute Resolution
7.1 The European Commission provides a platform for online dispute resolution, which can be found here: https://ec.europa.eu/consumers/odr
7.2 We are not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.
8. Final Provisions
8.1 Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall not be affected.
8.2 The contracts between us and you are exclusively subject to German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG)
